Agency
Alabama’s administrator is the Unclaimed Property Division of the Office of the Alabama State Treasurer. It takes custody of dormant intangible property — including unclaimed surplus reported from foreclosure and tax-sale distributions — and holds it for owners and heirs (the Treasury reports holding over $1 billion).

How surplus escheats here
Note: alabama’s tax-sale structure historically limits the surplus generated at sale (it is a Tyler pressure point — see escheat-and-unclaimed-property and surplus-funds). Where intangible surplus or excess funds are reported, they are remitted to the State Treasurer’s Unclaimed Property Division under the custodial model. Alabama’s Uniform Disposition of Unclaimed Property Act sets a general three-year dormancy for most property (ranging roughly three to five years by type). (Source: Office of the Alabama State Treasurer, https://treasury.alabama.gov/unclaimed-property/, retrieved 2026-06-02; statutory cite: Code of Alabama §§ 35-12-70 et seq.; the Treasury must act on claims within 120 days under Ala. Code § 35-12-83, and there is no time limit to file a claim.)
The taking is custodial; binding pre-escheat deadlines sit upstream and appear on the alabama page (Module 3).
Claiming
Search by name on the portal, file the matched claim, and submit proof of identity and ownership. Heirs claim through estate documentation. The Treasury must act within 120 days (§ 35-12-83). No fee.
▸ For Former Owners. Search alabama.findyourunclaimedproperty.com by your name — Alabama holds over $1B in unclaimed funds with no deadline to claim, and the Treasury must act on your claim within 120 days. Free to file.
▸ For Investors / Operators. Alabama’s sale structure limits surplus at origin (a
Tylerpressure point); any reported surplus escheats to the state Treasurer fund (custodial), not a county forfeiture pool. Confirm whether a surplus is generated at all on the alabama page before modeling strategy.
