How surplus escheats here

When a tax-foreclosure or mortgage-foreclosure sale generates a surplus that the former owner never claims, the funds follow the path described in escheat-and-unclaimed-property: after the disbursing office’s own claim window runs, the residue is reported and delivered to the state unclaimed-property administrator as a dormant intangible, where it is held custodially (the State takes custody, not title). For Arkansas-specific surplus mechanics, the disbursing office, and any upstream county/clerk forfeiture deadline that can cut off the surplus before it reaches the Auditor, see arkansas Module 3.

The Auditor’s office states it keeps unclaimed property for the rightful owners with no time limit to file a claim — consistent with the custodial model. The exact statutory dormancy period and cite under Arkansas’s Unclaimed Property Act are needs_verification against the primary statute (Ark. Code Ann. tit. 18, ch. 28). Claiming

Search by name at https://www.claimitar.gov/ , then file a claim online or by mailed form. The owner, the owner’s estate, or a lawful heir may claim. Proof typically required: government-issued photo ID, Social Security number, and documentation linking the claimant to the reported address/property; estates and heirs submit additional probate or heirship documentation. There is no fee to file directly with the State.

▸ For Investors / Operators. Surplus reaching the Auditor’s custodial fund does not revive a redemption right or cloud title you acquired at sale — it only reroutes money owed to the former owner. The diligence question is upstream: confirm on arkansas whether surplus is forfeited at the county/commissioner level before escheat.

▸ For Former Owners. If a foreclosure or tax sale on your former property left a surplus and you never claimed it, search https://www.claimitar.gov/ by your name and any prior names/addresses. Filing directly with the State is free and the Auditor reports no deadline. If the claim involves an estate, multiple heirs, or contested ownership and you want it handled end-to-end, .
