How surplus escheats here

When a tax-foreclosure or mortgage-foreclosure sale generates a surplus that the former owner never claims, the funds follow the path described in escheat-and-unclaimed-property: after the disbursing office’s own claim window runs, the residue is reported and delivered to TRD as a dormant intangible, held custodially (custody, not title). Claiming

Search by name at https://nmclaims.unclaimedproperty.com/ . For claims valued at $500 or less, you can file fully online (name, date of birth, SSN, and a security question for identity verification); larger claims, deceased-owner claims, and multiple-owner claims require a PDF form uploaded to the site. The owner, estate, or lawful heir may claim. There is no fee to file directly with the State.

▸ For Investors / Operators. Surplus reaching TRD’s custodial fund does not revive a redemption right or cloud title acquired at sale — it only reroutes money owed to the former owner. Confirm on new-mexico whether surplus is forfeited at the county level before escheat.

▸ For Former Owners. If a foreclosure or tax sale on your former New Mexico property left a surplus you never claimed, search https://nmclaims.unclaimedproperty.com/ by your name and prior addresses; small claims ($500 or less) can be filed entirely online for free.
