West Virginia’s administrator is the Unclaimed Property Division of the West Virginia State Treasurer’s Office (WVSTO). It takes custody of dormant intangible property — including unclaimed surplus reported from foreclosure and tax-sale distributions — and holds it for owners and heirs.

How surplus escheats here
Unclaimed foreclosure/tax-sale surplus in west-virginia not claimed from the disbursing court or sheriff is reported and remitted to the State Treasurer’s Unclaimed Property Division under the custodial model in escheat-and-unclaimed-property. The custodial taking means the owner’s reclaim right survives the dormancy clock; the binding deadlines are upstream at the sheriff/court and appear on the west-virginia page (Module 3).

Search by name on the portal, file the matched claim online, and upload proof of identity and ownership (ID, SSN, and documents tying the claimant to the reported owner/address or foreclosed property). Heirs claim through estate documentation. No fee.

▸ For Investors / Operators. Unclaimed surplus escheats to the state Treasurer fund (custodial, reclaimable), not a county forfeiture pool — a later owner claim does not cloud acquired title or revive redemption. Confirm the sheriff/court surplus clock on the west-virginia page.
