Aersale v. Total Air Services

Complete three-page opinion and footnotes retrieved/read in an unofficial-hosted court PDF. Filed April 20, 2022.

Facts and holding

Two aircraft owners challenged summary judgment validating liens for fuel supplied in 2017. Affirmed: section 329.41’s fuel lien was not possessory under the 2017 statute. The 2019 amendment expressly removing possession as a perfection requirement clarified existing law rather than changing it.

The court cites florida-jv-air-maintenance-v-westwind-2019 for the definition of a possessory lien, not to equate fuel and repair enforcement.

Limits

Lien validation is not a ruling on completed buyer title, every lender’s priority or fuel-only self-help under the entrusted-repair statute 85.031(2). The actual amendment retains section 329.51’s competing-priority/FAA-recording qualifications. Comprehensive later treatment remains unverified.

Independent Primary-Text Comparison — 2026-10-17

No universal rival-lender priority holding; fuel is not an entrusted repair article merely because both involve aircraft. Current operative comparison: § 329.41; § 329.51. Full holding verification is not a comprehensive still-good-law certificate. Where the former source URL failed, the working full-opinion source now appears in metadata; original failed receipts remain separate in the review evidence.
