Pro Finish, Inc. v. Estate of All American Trailer Manufacturers, Inc.
Full five-page court opinion, including footnote, retrieved 2026-10-17.
Holding and limits
Applying the 2013 statute, untimely petitioning and publication invalidated the assignment. The court reversed the orders approving the final report and denying lien reinstatement, and remanded; it also found approval of the sale erroneous. It did not reach the creditor’s other two arguments.
A requested free-and-clear sale is not proof of universal lien discharge. The opinion’s historical bond-filing timetable must not displace the current § 727.104 text. See florida for current statutory procedure.

Independent Primary-Text Comparison — 2026-10-17
No general free-and-clear power holding; 2015 federal standing appeal is procedurally different and not treated as substantive approval. Current operative comparison: § 727.104; § 727.109; § 679.3151. Full holding verification is not a comprehensive still-good-law certificate. Where the former source URL failed, the working full-opinion source now appears in metadata; original failed receipts remain separate in the review evidence.
