Giant Cab, Inc. v. CT Towing, Inc. (2019)

Decided: August 27, 2019. Full primary opinion retrieved on an unofficial reporter host; reader-only versus raw-body provenance is identified in the New Mexico source catalog. giant

Facts

After police arranged removal of a damaged taxi, the owner sought the separate taxi meter, roof light and relay. Removal was quick and did not damage the vehicle; the towing company insisted on payment before release. The district court awarded damages and costs. The tow company disputed both whether its vehicle lien covered the equipment and whether the owner supplied sufficient proof of ownership. giant

Holding and disposition

Affirmed on both contested issues. On this record the removable taxi equipment did not become part of the motor vehicle encumbered by §48-3-19. Substantial evidence also supported the finding that proof of ownership satisfied the governing towing rule, so release of the separate personal property could not be conditioned on paying the vehicle tow bill. giant

Reasoning and complete remedial treatment

The opinion considers intent to merge the equipment, physical integration/removability and diminished vehicle value, and whether the provider relied on the additions’ permanence in extending services. The district court’s ownership-proof finding was supported by the evidence and admissions; appellate review did not reweigh it. The towing rule required proof-based access/removal without an extra charge. giant

Practical impact and limits

This is not an exemption for every accessory or inseparable component, not a lender-priority case and not a general clean-title auction decision. The court affirmed damages/costs for withholding the distinct goods on the facts proved, not a universal damages tariff. giant

Treatment and currentness boundary

The complete paragraphs1–21 were reviewed, not the search summary. Operative 18.3.12 NMAC was replaced effective July1,2024; section24 retains free proof-based personal-property release and section26 independently governs prompt ownership/lender notices and loss of storage claims for noncompliance. Later rule text is identified separately from the2015 rule applied in the case. No comprehensive citator or still-good-law certificate is supplied. giant towing-rule
