Kellogg Valley Motor Sales, Inc. v. Bowdie (2003)
Citation: Adv. No. 4:01-ap-4123, in In re Sonyia Henry, No. 4:00-bk-42374 E. Court: U.S. Bankruptcy Court, E.D. Arkansas, Little Rock Division. Signed: January 16, 2003; the order’s entry notation is January 17, 2003. Official full order.
Facts
Kellogg sold and financed the debtor’s 1993 Jeep Cherokee and had a perfected security interest shown on the title. The debtor delivered the Jeep to Bowdie’s shop for repairs. Bowdie claimed a repairman’s lien. The parties did not dispute the facts material to Kellogg’s motion for partial summary judgment on priority. Order, p. 1.
Holding
The court granted Kellogg partial summary judgment: its perfected vendor purchase-money lien was superior to Bowdie’s repairman’s lien under Ark. Code Ann. § 18-45-202(b). It set the remaining complaint for trial; this was not a final decision validating a completed lien auction or deciding all remedies. Order, pp. 1–2.
Reasoning
The statutory exception subordinates a repairman’s lien to a perfected lien of the described financial institution or vendor for unpaid purchase money. Kellogg financed this vehicle’s sale and satisfied that rule. Footnote 1 distinguishes older authorities by noting that the 1999 amendment removed the vendor’s title-retention requirement. Order, pp. 1–2 and n.1; official Act 695 of 1999.
Practical impact
A repair-lien purchaser must identify the financing lien and its purchase-money/perfection facts before assuming the shop has first priority. The opinion establishes this priority result; it does not establish that a repair sale extinguishes the superior lien. Owners and lienholders can distinguish priority litigation from a claim about sale notice or title issuance. Order.
Good-law status
needs_verification: comprehensive subsequent-treatment review was not completed. The retrieved holding is stated for the statute applied in 2003, not certified as current good law; later amendments and appellate treatment require verification.
The independent October 17, 2026 pass retrieved the full official order again and checked the 1999 priority amendment separately from the 2023 repair-enforcement amendment. Act 388 changes notices, the bond and remedies in §§ 18-45-204–205; it does not redecide this case or establish its appellate treatment. Searches for the case and later treatment did not produce a comprehensive citator result. Holding retrieval, statutory currentness and later judicial treatment remain separate checks. Act 388.
