How surplus escheats here
See escheat-and-unclaimed-property for the custodial-taking framework and
illinois for the controlling tax-sale and surplus statutes. Illinois is one of the
RUUPA-2016 adopting jurisdictions (Revised Uniform Unclaimed Property Act, 765 ILCS
1026) noted in escheat-and-unclaimed-property. Note that Illinois’s historical
tax-sale model is one in which surplus is often limited by design (see the
no surplus generated by design row in escheat-and-unclaimed-property and the
illinois page) — so the existence of a reclaimable surplus pool varies by sale type
and must be checked on the jurisdiction page.
Dormancy period: Under 765 ILCS 1026 (RUUPA) the general dormancy period is commonly
stated as three years; the precise period for sale-surplus / court-held funds is
needs_verification against the current statute. Do not rely on a single figure here.
Claiming
- Search by name or business name at icash.illinoistreasurer.gov.
- Select matching property (you may add several), then “Continue to file claim.”
- Provide proof of identity and ownership; documentation scales with amount and type; heirs supply estate paperwork.
- The Treasurer reviews and pays approved claims; free to file. (Source: https://icash.illinoistreasurer.gov/ , retrieved 2026-06-02.)
▸ For Investors / Operators. I-CASH escheat is a downstream money event that does not cloud acquired title or revive redemption. In Illinois, confirm whether the sale type even generates reclaimable surplus before modeling any surplus-linked strategy — see illinois Module 3.
▸ For Former Owners. If your Illinois property sold and surplus may exist, search I-CASH for free at icash.illinoistreasurer.gov. Filing is free; once funds are in the Treasurer’s custody the claim is not time-barred. Because Illinois’s tax-sale model can limit surplus, also check the county and the sale type.
