The execution creditor levied on a debtor’s fixtures and inventory. A previously perfected secured lender filed a third-party bond and obtained dissolution of the writ, effectively treating its collateral as exempt from execution.

The court reversed. A prior security agreement creates a lien, not immunity from another creditor’s execution. The execution creditor may sell the debtor’s interest subject to the security agreement’s lien (p. 741). The court relied on Wildwood Crate and the then-current UCC’s alienability provision. It did not establish a sale-price minimum or hold that all judgment liens survive.

The full 2023 report adopted with a separate possession exception in florida-highland-consulting-v-soule-2023 actually applies Altec to vehicle execution sales. Current §§ 679.3151 and 679.401 distinguish continuation of a security interest from transferability of the debtor’s interest; see florida. This verified later application is not a comprehensive citator certificate.
