Highland Consulting Group v. Minjares Soule
The actual twelve-page March 9, 2023 report and four-page April 3 adoption order were retrieved from GovInfo and read in full. This page does not present an unadopted recommendation as a final holding.
Decision
Federal Rule 69(a)‘s Florida-law execution process produced a vehicle auction. The adopted report applies Carantzas: paid purchase price transfers title; section 56.25’s bill issuance is ministerial; a permitted creditor credit bid counts as payment. Paid title and physical possession are distinct where a lender obtains separate legal process. Unpaid bidders did not get a bill or release merely by winning the auction.
The district judge adopted the report’s analysis except its recommended release of the 2019 Porsche after the lender obtained an intervening state replevin writ. Four listed vehicles were released. Bills were ordered for the paid 2017 BMW and 2019 Porsche without granting the requested possession; the order preserved other lender legal process and retained all proceeds pending accounting/further order (DE 559, pp. 3–4).
Limits
The report states that pre-existing secured liens were not extinguished; the case does not decide every junior lien, federal claim or every other forced-sale channel. Its payment extension was an actual court order, not a universal statewide bidder credit period. The earlier November 2022 sale was vacated for notice defects, so its initial release order is not substituted for the operative February-auction/adoption disposition. Later appellate/ comprehensive treatment remains unverified.

Adoption exception and changed custody preserved. Actual payment extension was a court order, not a statewide installment term. Current operative comparison: § 56.25; § 679.3151; § 679.609. Full holding verification is not a comprehensive still-good-law certificate. Where the former source URL failed, the working full-opinion source now appears in metadata; original failed receipts remain separate in the review evidence.
