A repair shop retained a debtor’s car for unpaid repair and later asserted storage charges. The bankruptcy court recognized the repair claim but rejected the storage lien: there was no storage agreement, and artisan possession did not itself secure storage charges. It ordered turnover subject to adequate protection, including continued lien protection, insurance, an initial payment and plan treatment.
The court discussed williamsport-national-bank-v-shrey-pa-1992 and treated the repair lien as prior for this debtor proceeding. The finance lender was absent, its rights were expressly reserved, and the debtor conceded priority. This opinion therefore must not be presented as a binding adjudication against that lender.
It also repeated parks-v-mr-ford-pa-1977’s description of the summary-sale provisions as unconstitutional. That is actual 1998 treatment, not a controlling resolution of Flagg Bros. and Chrysler’s questioning of Parks. The opinion’s bankruptcy statutory-lien classification does not itself establish that Act 300 creates every underlying state-law artisan lien.
morgan-v-3d-metal-works-pa-2014 later cites Northrup on the continuing lien. The body and these identified treatment points are verified; current constitutional applications, purchaser discharge and complete subsequent history remain needs_verification.
Applies in pennsylvania.
