Morgan v. 3D Metal Works (2014)

Citation: No. 81 MDA 2014, J-S56032-14 (Pa. Super. Nov. 19, 2014) (nonprecedential memorandum). Court: Superior Court of Pennsylvania. Full official court opinion retrieved October 17, 2026.

A repairer obtained a judgment for unpaid truck repairs. Bankruptcy avoided its judicial lien and discharged personal debts, while an order recognized an unavoidable common-law lien. The owner later obtained an injunction against sale; the repairer appealed.

The Superior Court reversed and vacated the injunction. On the undisputed lien and bankruptcy record, it held that the trial court erred in treating parks-v-mr-ford-pa-1977 as dispositive of the sale prohibition. The memorandum discusses Flagg Bros. and Chrysler’s later questioning of Parks. It separately treated an inadequately developed argument as waived.

This is expressly NON-PRECEDENTIAL under the rule printed on the memorandum. It supplies actual later judicial treatment and a factual example; it is not a binding statewide endorsement of all statutory auctions or a ruling on every senior lender’s interest. The 1925 Act 300 exists even though present constitutional applications require further review.

The complete eight-page PDF is now recovered from the court’s actual published path. The prior Justia reproduction and its successful full-body evidence are preserved despite failed older court paths. The official extraction matches that prior full text. Verification does not certify later treatment, precedential force or current sale validity. All such conclusions remain needs_verification.
