Facts
Iowa Truck Center repaired a truck at the owners’ request and refused to give it back until paid. The owners allegedly took the truck from the shop anyway. Iowa Truck Center sued in replevin, alleging it was the “qualified owner” of the truck by virtue of its artisan’s lien. The trial court dismissed the petition, holding that replevin is not available to the holder of an artisan’s lien. These are the pleaded facts reviewed on dismissal, not final trial findings. Full opinion.
Holding
Reversed and remanded. An artisan’s lienholder’s immediate possessory right can sustain replevin against the actual owner. As between those parties, the owner’s involuntary taking does not waive or destroy the lienholder’s possessory right. The court decided the sufficiency of the petition, accepting its well-pleaded facts; it did not finally establish the amount or validity of the repair debt, lender priority, or title acquired at a lien sale. Full opinion, parts I–V.
Reasoning
Replevin turns on the immediate right to possession of specific personal property when the action starts, and it can be maintained even against the true owner. A motion to dismiss admits the well-pleaded facts, and the shop pleaded that it did not surrender the truck voluntarily. The lien supplies an interest in the specific property sufficient for that immediate possessory claim. Full opinion.
Practical impact
- Buyers of vehicles or equipment from an owner who has taken them back from a shop: an Iowa artisan’s lien survives an involuntary loss of possession as between shop and owner, and the shop can pursue recovery by replevin. Ask whether repair bills are unpaid. See iowa module 12.3. Full opinion.
- Shops: current ch. 577 incorporates § 554.7308 sale procedure. Section 577.1 subordinates the ordinary lien to prior liens of record unless notice and written consent satisfy the statute; subsection 2 supplies the special airline-avionics branch. These current statutory rules are separate from the case’s shop-versus-owner holding.
Good-law status
The full opinion and current ch. 577 were checked on 2026-10-17. A Woodbury County district-court ruling entered June 4, 2025, in LACV205399, expressly applies this decision’s possessory-right rule when reviewing conversion/artisan-lien issues. It also requires owner assent and qualifying repair/service work; possession alone does not establish a valid lien. Actual filed ruling, pp. 3–11. This is affirmative, bounded later treatment, not a comprehensive citator certificate. The 1973 decision remains a pleading-stage holding; the 2025 trial ruling is not an appellate extension to priority or sale-title questions.
