Levitch v. Link (1917)

Decided: April 13, 1917 · Docket: 13903.

Holding and reasoning

An earlier valid chattel mortgage outranked a later stable-keeper lien. Retention and summary-sale powers did not themselves create priority. The court reversed and directed protection of the liens in chronological order, distinguishing statutes expressly granting priority over other liens. Complete judicial opinion, unofficial Hall reproduction.

Currentness and later treatment

The full Brazier majority expressly discusses this distinction. Current RCW 62A.9A-102, -109, -308, -310, -322 and -333 separately govern scope, agricultural perfection and possessory-lien priority. The 1993 agister act adds proceeds/collection rights; the historical mortgage affidavit is not a modern perfection instruction. Transaction classification and later legal changes must be applied separately; comprehensive treatment remains needs_verification. Full current Article 9A; full enacted 1993 c. 53; in-re-brazier-forest-products-wa-m12-1986.
