McCurdy v. Secretary of State, Bureau of Motor Vehicles (2020)
Facts and holding
After a police-directed tow, McCurdy retrieved belongings but not his vehicle and did not pay the towing/storage charges. BMV notified him of the abandonment application, treated his objection as a hearing request, held a hearing, and ordered title transferred unless he paid the reduced amount of USD 730 by the specified deadline.
The court affirmed under Rule 80C: evidence supported statutory notice and nonpayment under 29-A §§1852–1856. McCurdy’s objection to abandonment and his additional constitutional, contract and fraud arguments did not establish reversible error. The court did not adjudicate an unpaid third-party lender’s priority, a later purchaser’s good faith, or an independent-entity §1862 transfer. Full five-page order, archived university court-copy PDF.

Current §665(3) makes a new certificate nonconclusive of the former named owner’s/lienholder’s rights; the agency’s currently posted Chapter 102 also must be distinguished from this opinion’s statutory analysis. Holding verification is not an exhaustive citator certification.
