Essex County, New Jersey — Tax Sale & Surplus Procedure

Local operations layer. The legal framework (tax-lien-certificate mechanics, post-P.L. 2024 c.39 surplus reform, mortgage foreclosure statutes, case law) lives on the parent page → new-jersey. This page covers how Essex County actually runs it: which offices act, which platforms are used, and where surplus claims are filed. Legal information, not legal advice. Last verified: 2026-06-02.

C0. Identity

  • County seat: Newark · FIPS: 34013
  • Recording unit: county — Essex County is one of 21 NJ counties; deeds and mortgages are recorded at the Office of the Essex County Register of Deeds and Mortgages (distinct from the County Clerk — see C4).
  • Population: ~881,527 (2024 Census estimate); ~896,379 (2025 estimate). Second-most populous county in New Jersey. (U.S. Census Bureau QuickFacts)
  • Municipalities: Essex County contains 22 municipalities, each of which independently conducts its own annual municipal tax-lien-certificate sale under state law — there is no county-level tax sale. (essexregister.com/municipalities)
  • Parent legal framework: new-jersey (N.J.S.A. Title 54 ch. 5; P.L. 2024, c.39; Fair Foreclosure Act N.J.S.A. 2A:50-53 et seq.)

C1. Local Tax Sale

Key architecture: municipal, not county

New Jersey law (N.J.S.A. 54:5-1 et seq.) requires every municipality to hold at least one tax-lien-certificate sale per year for delinquent property taxes/charges — the county plays no direct role in running these sales. Each of the 22 Essex County municipalities (Newark, Irvington, Montclair, West Orange, Bloomfield, Belleville, Caldwell, Cedar Grove, East Orange, Essex Fells, Fairfield, Glen Ridge, Livingston, Maplewood, Millburn, North Caldwell, Nutley, Orange, Roseland, South Orange, Verona, West Caldwell) conducts its own sale through its municipal Tax Collector. (NJ DLGS Elements of Tax Sales)

Platform — municipal-level

Individual Essex County municipalities use their own auction platforms; no single county-level aggregator was identified. Examples observed:

  • Newark (largest municipality): conduct details available through the Newark Finance Department / Division of Revenue Collections, 920 Broad St., Room 104, Newark, NJ 07102; phone 973-733-8098. (taxsaleresources.com – Newark)
  • Essex Fells: uses the online platform https://essexfells.newjerseytaxsale.com; 2025 sale was Monday, December 8, 2025 at 9:00 a.m. (essexfellsboro.com)
  • West Orange: conducted by the West Orange Tax Collector, 66 Main Street, West Orange, NJ 07052; phone 973-325-4100. Annual, as required by state law. (westorange.org)
  • Nutley: operates an annual municipal tax sale; details at nutleynj.org/taxsale.

For any specific municipality’s next scheduled sale date, contact that municipality’s Tax Collector directly. The Essex County Tax Board maintains a Municipal Assessor & Collector Directory (PDF) at: https://www.essexcountynjtaxboard.org/wp-content/uploads/2025/09/Assessors-Collectors-Phone-Listing-revised.pdf (essexcountynjtaxboard.org)

Bid mechanics / statutory rates

All municipalities follow the NJ statewide bid-down-interest / premium structure: interest starts at the statutory maximum of 18% and is bid down; once bidders reach 0% interest, bidding continues in premium increments of $100. See new-jersey for full mechanics (N.J.S.A. 54:5-32).

Certificate recording

After purchase, the winning bidder must record the tax sale certificate (TSC) at the Essex County Register of Deeds and Mortgages (Hall of Records, 465 Martin Luther King Jr. Blvd., Newark) within approximately 90 days. (NJ DLGS)

Delinquent list location

Each municipality publishes its own delinquent-taxpayer notice, typically in a local newspaper and/or on the municipal website. No county-level delinquent-list aggregator was identified. — needs_verification

C2. Local Redemption → framework: right-of-redemption

  • Where to redeem: redemption of a TSC is made through the municipal Tax Collector that issued the certificate, at the respective municipal tax office. See the Municipal Assessor & Collector Directory (C1) for each municipality’s contact. (NJ DLGS)
  • Local fees: state-statutory only — redemption amount = certificate face amount + bid interest (up to 18%) + 2/4/6% redemption penalty (depending on certificate amount) + subsequently paid taxes + lawful costs. No Essex County surcharge identified.
  • Redemption contact: the municipal Tax Collector for the specific municipality; the Essex County Tax Board (C4) can provide directory assistance.
  • Deviations from state default: none identified. Once a TSC foreclosure action is filed in Superior Court, any redemption requires intervention in that court action (Simon v. Cronecker, 189 N.J. 304 (2007) — see new-jersey).

C3. Local Surplus / Excess Proceeds → framework: surplus-funds

Essex County has two distinct surplus regimes depending on the sale type. Both ultimately route through New Jersey Superior Court — there is no county-specific surplus office separate from the court system.

Regime A: Tax-lien-certificate (TSC) foreclosure surplus (post-P.L. 2024, c.39)

Following the NJ Supreme Court’s 2025 decision in 257-261 20th Avenue Realty, LLC v. Roberto and the P.L. 2024, c.39 reform, a former owner/heir may demand that the TSC holder foreclose “in the same manner as a mortgage” — producing a sheriff’s sale or Internet auction — preserving equity above the lien. The resulting surplus is deposited with the Superior Court Clerk under the same N.J.S.A. 2A:50-37 waterfall used for mortgage foreclosure surplus. See new-jersey § 3 for statutory details.

Regime B: Mortgage-foreclosure (sheriff’s sale) surplus

  • How surplus is generated: When the Essex County Sheriff conducts a judicial foreclosure sale and the winning bid exceeds the judgment amount, the Sheriff deposits the net surplus into the NJ Superior Court Trust Fund (held centrally in Trenton). (scura.com – NJ surplus funds; metrickesq.com – surplus guide)

  • Claim filing venue (BUSINESS-CRITICAL):

    • Primary court for Essex County foreclosures: Essex County Superior Court, Civil Division (Chancery / General Equity Section) Essex County Veterans Courthouse, 50 West Market Street, Suite 131, Newark, NJ 07102; phone (973) 776-9300 ext. 56900 (General Equity/Chancery). (njcourts.gov Essex offices)
    • Surplus funds are held by the NJ Superior Court Trust Fund (centralized in Trenton, not county-local): SCCO Trust Fund, Richard J. Hughes Justice Complex, P.O. Box 971, Trenton, NJ 08625-0971 (hand delivery: 25 Market Street, Trenton, NJ 08625). Phone: 609-421-6100 · Email: SccoTrustfund.Mailbox@njcourts.gov. (njcourts.gov SCCO Trust Fund)
  • Claim form / process: No single printed claim form. The claimant must:

    1. Contact the Surplus Funds Unit (609-421-6100 / SccoTrustfund.Mailbox@njcourts.gov) to confirm the surplus amount and receive a Verified Order.
    2. Prepare a motion packet with the Verified Order, proof of service via certified mail to all parties named in the foreclosure complaint (green cards required), and file with the Essex County Superior Court.
    3. Once the Court approves, obtain a Certified and Sealed Order and submit it to the Surplus Funds Unit to receive a check. (metrickesq.com surplus guide) Typical timeline: 6–9 months from sale to receipt. Court Rule: NJ Court Rules 4:64-3 and 4:57-2.
  • Local deadline notes: New Jersey generally gives former homeowners approximately 6 months from the sale date to file a claim before junior lienholders take priority; however, the right to claim does not absolutely expire within that window — consult the court rules and an NJ attorney. needs_verification (precise NJ deadline not retrieved against a primary-rule citation; general 6-month guidance from corroborating law-firm sources only).

  • Priority waterfall: (1) Junior mortgages/HELOCs; (2) Judgment creditors; (3) Former homeowner. Controlled by N.J.S.A. 2A:50-37 — see new-jersey.

  • Unclaimed-funds list published? No county-specific surplus list was identified. Unclaimed funds deposited with the Superior Court Trust Fund are ultimately subject to NJ’s Unclaimed Property Act; the NJ Department of the Treasury’s Unclaimed Property Administration at https://www.njconsumeraffairs.gov/unclaimed/ may carry some court-deposited funds. — needs_verification

  • Contact for Essex foreclosure surplus: Essex County Superior Court Civil Division — 973-776-9300 ext. 56900; NJ SCCO Trust Fund — 609-421-6100 / SccoTrustfund.Mailbox@njcourts.gov.

▸ For Investors / Operators — Essex County has no county-level tax sale; each of its 22 municipalities runs its own annual lien-certificate auction (bid-down 18% → premium increments). After winning a certificate, record it at the Essex County Register of Deeds and Mortgages (465 Martin Luther King Jr. Blvd., Room 130; (973) 621-4960) — the Register and County Clerk are separate offices. Mortgage foreclosure sheriff’s sales run bi-weekly Tuesdays at 1:30 PM at 60 West Market Street, Newark (14th Floor); 20% deposit by money order or certified check; track active listings at salesweb.civilview.com/Sales/SalesSearch?countyId=2. Under P.L. 2024, c.39, TSC foreclosure complaints must now conspicuously disclose the owner’s right to demand a judicial sale preserving equity.

▸ For Former Owners — Mortgage-foreclosure surplus from Essex County sheriff’s sales is deposited with the NJ Superior Court Trust Fund in Trenton (609-421-6100; SccoTrustfund.Mailbox@njcourts.gov) and claimed by motion at the Essex County Superior Court, Civil Division (50 West Market Street, Suite 131, Newark; (973) 776-9300 ext. 56900). The process takes approximately 6–9 months; the priority waterfall (N.J.S.A. 2A:50-37) runs junior mortgages first, then judgment creditors, then the former owner. For TSC foreclosure surplus under the post-P.L. 2024 c.39 reform, see new-jersey § 3.

Important distinction: the Register of Deeds and Mortgages (Hall of Records, 465 MLK Blvd.) handles all deed/mortgage/lien recording — not the County Clerk. The County Clerk (495 MLK Blvd.) handles passports, IDs, notary oaths, and business filings. (essexclerk.com)

C5. Local Procedure Notes

  • No county-level tax sale. NJ is a state of 566 independent municipal tax sales. Essex County’s 22 municipalities each run their own annual sale; the County has no role in conducting those sales.
  • Sheriff’s sale platform: The Essex County Sheriff publishes live foreclosure listings at https://salesweb.civilview.com/Sales/SalesSearch?countyId=2 (SalesWeb / CivilView, a Tyler Technologies product). Data refreshes every 30 minutes, 9 a.m.–4 p.m. weekdays. (salesweb.civilview.com)
  • Sheriff sale schedule: Bi-weekly Tuesdays at 1:30 PM at the Leroy F. Smith, Jr. Public Safety Building, 14th Floor Conference Room, 60 West Market Street, Newark, NJ 07102. Registration is day-of-sale only, 12:30 PM–1:30 PM. (essexsheriff.com foreclosure listings)
  • Sheriff sale deposit: 20% of bid price, payable immediately by money order, certified check, or bank check only (no cash, company, agency, or personal checks). Balance due within 30 days; 7.5% annual interest accrues from day 11 onward. Minimum opening bid $100 (plaintiff); subsequent bids must increase by$1,000 increments. (essexsheriff.com)
  • TSC recording: Winning TSC buyers record at the Register of Deeds and Mortgages (973-621-4960); the Register’s PRESS online system allows post-recording verification.
  • Two-office caution: operators must distinguish (a) municipal Tax Collector (runs TSC sales, accepts redemption) from (b) County Sheriff (runs mortgage/judicial foreclosure sales); and (c) Register of Deeds (recording) from (d) County Clerk (no recording role).
  • Post-reform TSC surplus demand: under P.L. 2024, c.39 the TSC holder’s foreclosure complaint must now conspicuously state in boldface the owner’s right to demand a judicial sale / Internet auction to preserve equity — see new-jersey § 3.

C6. Records Access

Note: Essex County NJ does not appear to maintain a standalone county GIS parcel-viewer website (results consistently returned Essex County NY portals). The official NJ statewide GIS parcels at njgin.nj.gov are the closest substitute. — needs_verification (no official Essex County NJ GIS URL retrieved)
