REGIME NOTE: Chapter 141 judicial foreclosure, NOT Chapter 140. Jackson County (Kansas City metro) is a first-class charter county that operates under Chapter 141 RSMo — the Land Tax Collection Law (judicial foreclosure). This is fundamentally different from the Chapter 140 certificate-of-purchase model used by most Missouri counties. The county files a lawsuit in the 16th Circuit Court seeking a judgment of foreclosure; after judgment a sheriff’s sale (run by the court’s Civil Process Department) is held; and the circuit court holds a confirmation hearing before any deed issues. There is no certificate of purchase and no post-sale redemption right after the confirmation order becomes final. Pre-sale redemption is available at any time before the sheriff’s sale by paying all taxes + penalties + attorney/suit costs to the county collector (RSMo 141.420).

C2. Local Redemption → framework: right-of-redemption
- Where/how to redeem: Under Chapter 141, the right to redeem runs until the sheriff’s foreclosure sale. Any person with a right, title, or interest in — or lien upon — the property may redeem by paying to the Jackson County Collection Department all sums in the foreclosure petition (principal, interest, penalties, attorney’s fees, and costs then due). - Redemption period: Pre-sale only — the right to redeem expires at the moment of the sheriff’s foreclosure sale. There is no statutory post-sale redemption right under Chapter 141 (in contrast to Chapter 140’s 1-year / 90-day post-sale windows).

Chapter 141 judicial model (key structural difference from Ch. 140): Unlike most Missouri counties, Jackson County does not sell tax-lien certificates or issue a collector’s deed. The entire process is court-driven: lawsuit → judgment → sheriff’s sale → confirmation hearing → Court Administrator’s Deed. Bidders acquire property immediately (no redemption period post-sale), but the confirmation hearing provides a window for former owners or interested parties to challenge the adequacy of the sale price.

Confirmation hearing — adequate consideration review: RSMo 141.580 requires the court to determine whether “adequate consideration has been paid.” If the court finds the price inadequate, it may require the purchaser to increase the bid or disapprove the sale entirely. This review makes Jackson County sales somewhat riskier for buyers who acquire significantly below market value.

20-day appeal window after confirmation: Purchasers do not receive their Court Administrator’s Deed until 30 days post-confirmation, which includes a 20-day appeal window. If a former owner or lienholder files a timely appeal, deed issuance is delayed.

Properties sold “as is”: All DLT sales are final and sold as-is. The county makes no warranty as to condition or title. Purchasers assume responsibility for any hazardous materials, additional taxes not included in the judgment, mechanic’s liens, federal liens, and unpaid municipal taxes. Not all liens extinguished: Because this is a judicial foreclosure of the tax liens in the suit, federal tax liens and liens not named in the suit may survive.
