Facts
An earlier perfected purchase-money lender sought possession of a car from a repair garage planning a statutory lien sale. The garage had omitted the initial secured-party lien notice.
Holding
The garage retained priority of possession for the proposed §16-207 sale. The nonpossessory lender was not an owner entitled to §16-208’s special replevin remedy. Affirmed.
Reasoning
The statutory motor-vehicle exception preserved repair-lien priority despite missing §16-203 notice; the omission removed storage charges. The court distinguished priority during the sale process from ordinary secured-creditor priority.
Practical impact
Check which notice was omitted. This holding does not validate every defective sale or title package. See maryland and towing-storage-and-mechanics-lien-sales.
