Decided: June 26, 2024. Opinion: Thomas Marcelle, J. Full official opinion, including five footnotes, independently retrieved 2026-10-17.
Facts and issue
The owner requested an October 9, 2023 tow and signed an authorization specifying towing, equipment, labor and daily storage charges. The tower contacted the lender in November; both parties then delayed. The lender sought return in February 2024, and the vehicle was released under court order April 1. The tower claimed $15,057.41. The lender sought cancellation.
Holding and reasoning
The trial court upheld a $7,400 lien: $350 towing plus 94 days’ storage at $75. The remaining claim was invalid. The contract supported towing/storage, but vague equipment/labor charges were not supported. Section 184(4) did not require a tow-only business to register as a repair shop. Police-requested-tow notices under § 184(2)/(5), and municipal abandoned-vehicle procedures, did not apply to this owner-requested tow. Inclusion of some unauthorized charges did not alone destroy the whole lien. Equity allocated the parties’ unreasonable delays and excluded specified storage intervals (84 Misc 3d at 645–650 and nn. 1–5).
Practical impact
Do not import police-tow notice rules into every private tow or treat any excessive item as automatic total forfeiture. This was a lien-amount/return proceeding, not approval of an auction or adjudication of purchaser title. It does not excuse pre-sale Lien Law 201 notice.
Historical fit and later treatment
Current Lien Law 184 retains the material owner-request/police-request distinction and conditional repair-registration rule. This is a Supreme Court trial ruling, not binding appellate resolution. Exact-name/citation public searches on 2026-10-17 found the decision and bound-volume reproduction, not verified later merits treatment or appellate disposition. Those unresolved questions remain needs_verification; absence of an indexed result is not proof of good law.
